What Is a Restraining Order?

In New Jersey, a restraining order (also called a protective order) is a court order that prohibits one person from contacting or going near another. It is designed to protect victims of domestic violence, harassment, stalking, or threats.

Under the Prevention of Domestic Violence Act, restraining orders can:

  • Prohibit contact, harassment, or abuse
     
  • Order the accused to leave a shared home
     
  • Grant temporary custody or child support
     
  • Require the surrender of firearms
     
  • Establish distance requirements from a person, home, or workplace

Types of Restraining Orders in New Jersey

There are two main types of restraining orders:

  • Temporary Restraining Order (TRO):
    Issued quickly by a judge if there is immediate danger. The TRO provides short-term protection until a court hearing.
     
  • Final Restraining Order (FRO):
    Decided at a court hearing (usually within about 10 days). Both sides present evidence, and if granted, an FRO can last indefinitely — unless the court later dissolves it.
     

Each type of order can have serious legal consequences, including restrictions on employment, housing, and child custody.


Who Can Request a Restraining Order?

You may be eligible to file if you:

  • Are 18 years or older (or an emancipated minor) and have been abused by a spouse, former spouse, someone you live or lived with, or someone you dated
     
  • Have a child in common with the accused person
     
  • Have been the victim of stalking, harassment, or sexual assault, regardless of relationship

How the Process Works

  1. Filing the Complaint: You can file for a restraining order at your local police department or the Family Division of the Superior Court.
     
  2. Temporary Order: A judge may issue a Temporary Restraining Order (TRO) immediately if you are in danger.
     
  3. Service of the Order: Police serve the TRO on the accused and provide a court date for the hearing.
     
  4. Final Hearing: Both sides may testify, present witnesses, and submit evidence. The judge will decide whether to grant a Final Restraining Order (FRO).
     
  5. After the Order: If an FRO is issued, it remains in effect permanently unless lifted by the court. Violations of the order result in immediate arrest and criminal charges.
